litigation and opposition from social groups and the courts. Users’ creations have been stifled
due to the prohibitive effects of litigation. The random selection of lawsuit targets might
even encourage violations of law. To preserve users’ freedom to access and use copyrighted
works, and to re-calibrate the balance between securing revenue for copyright owners
(producers) and providing breathing space for new technology developers (distributors) in
the UGC age, I draw insight from the earlier copyright history and propose a UGC platform-
oriented regime. This is the theme of the following four chapters.
