An Intermediary-oriented Approach
Huang: Imagine that you act as both a user and creator, what kind of copyright rule you
prefer? The current rule of “permission first and use later”, or a new rule of “free use
with compensation for commercial use”?
Participant B: As a user, I think “free use” suits me more. While as a creator, I would like
potential users to ask for my permission first. (Laugh)
Huang: What if you are acting both a user and a creator? For instance, you use Fan Chong’s
song when creating your own MV, and your MV is available for others to use. Under this
circumstance, which rule do you prefer?
Participant B: Well, I think the permission approach is better.
Huang: Do you think asking for permission is too troublesome and may stifle creativity?
Participant B: Well, actually it does cost you too much trouble. For instance, after we
indicating our purpose, Mr Fan gave his authorization quite promptly.
Huang: That’s true. Thank you so much for participating this research. It is really nice to talk
with you!
