A Study on the Role of UGC Platforms in Copyright Law: Appendix 5 Interview Record (Participant D)
              An Intermediary-oriented Approach

series for us, such as this kind of emotion.

Huang: You mean that CCTV is the copyright owner for the dramatic and quyi works? Has
CCTV brought copyright from the artists?
Participant D: Few performers have personal studios. Most of them are employees in
national institutions and they generally do not record their own works. Our channel will
select some of the exciting works to record, and then broadcast them in the programme.
After that, we can use these works in our new media such as the WeChat, weblog and
the client. Many artists do not care about copyright. I wonder whether it is because of
the particularity of the industry. Not many people are interested in watching traditional
dramatic and quyi works. So artists are very happy if there is someone willing to
                 disseminate their works.

Huang: Point taken. You constitutes the “producer of sound recordings and video recordings”
in the Chinese copyright law and you have neighboring rights. Performers also have
neighboring rights. And the creators for the music(唱腔), dance, costume and
props are copyright holders. I wonder whether CCTV will give you some training on
                 intellectual property right?
Participant D: We have no special training. But all the staff in our department belong to the
post-90s generation so we have the awareness of protecting intellectual property right,
at least for me. As for the photos, we have our own photographer. If we use photos made
by fans or other Internet users, we will @ them in WeBlog or WeChat. But we will not
go to trouble to ask for permission since they make these photos out of interest. Till now
                 no dispute has occurred.

Huang: “If the work is used in a video, the video will indicate the source or present itself
with a logo.” I wonder what these videos look like. Are they fragments directly cut from
